Wirri Lawn Care Subscription Service Terms and Conditions

Introduction: Wirri Lawn Care Subscription Service (“Wirri”, “we”, or “us”) operates the www.wirri.com.au site (the “Site”), providing lawn care products and services (collectively, the “Services”). These Terms and Conditions, along with any documents they incorporate by reference (collectively, the “Terms”), govern your access and use of the Site and Services. 

THESE TERMS CONTAIN AN ARBITRATION AGREEMENT AND CLASS ACTION WAIVER. PLEASE READ CAREFULLY AS THEY AFFECT YOUR LEGAL RIGHTS. 

By using the Services, you acknowledge that you have read, understood, and agree to these Terms. If you do not agree, do not use the Site or Services. 

1. Use of the Services: We grant you a personal, limited, non-transferable, non-exclusive licence to access and use the Services. We reserve the right to revise, change, suspend, or discontinue any aspect of the Services without notice or liability. Your continued use constitutes acceptance of any changes.

You are responsible for your use and must not use the Site or Services for unlawful purposes, to interfere with the Site, or to gain unauthorised access to other systems. Automated data collection tools are prohibited. You may not resell access to the Site or Services.

4. Billing and Payments: You must provide valid Payment Methods. Subscription fees and other charges will be billed to your Payment Method on the specified billing date. If payment fails, we may suspend access until payment is received. You can update Payment Methods in your account settings.

We reserve the right to change fees and will notify you of any changes. We use third-party payment services and are not responsible for their protection of your information. 

5. Cancellation: Subscriptions renew annually. To cancel, contact info@wirri.com.au before your renewal date. Cancellations are effective at the end of the current billing period. Fees are non-refundable.
6. Shipping and Risk of Loss: Shipping fees are included unless otherwise indicated. Notify us within 30 days of purchase for loss/damage claims. Replacement of items is at our discretion.
7. Referral Program: Registered customers may earn referral credits for new customer purchases. Credits are non-transferable and subject to review. Abusive behaviour may result in program suspension or termination.
8. Other Promotions: We reserve the right to refuse, suspend, or revoke promotions at any time.
9. Product Information; Limitation on Quantities: Product details are subject to change. Compliance with local laws is your responsibility. We may limit quantities or discontinue products without notice.
10. Proprietary Rights: Content on the Site is protected by intellectual property laws. Use is for personal, non-commercial purposes only. Unauthorised use is prohibited.
11. Abuse of Customer Service Agents: Abuse towards customer service agents will not be tolerated and may result in suspension or termination of your subscription.
12. Disclaimers: The Site and Services are provided “as is” without warranties. We are not responsible for third-party sites linked from our Site.
13. Indemnification: You agree to indemnify Wirri from any claims arising from your use of the Site or Services.
14. Limitation of Liability: To the maximum extent permitted by law, in no event shall Wirri, its parent company, subsidiaries, affiliates or any of their respective officers, directors, employees, agents, successors, suppliers, or third parties providing information on this site or with the services be liable to any user of the site or the services or any other person or entity for any indirect, special, incidental, consequential or exemplary damages (including, but not limited to, damages for loss of profits, loss of data, or loss of use) arising out of the use or inability to use the site or the services, whether based upon warranty, contract or tort (negligence), even if Wirri has been advised of or should have known of the possibility of such damages or losses. to the maximum extent permitted by law, in no event shall the total aggregate liability of Wirri, its affiliates or any of their respective officers, directors, employees, agents, successors, suppliers, or third parties providing information on this site or the services to you for any direct damages, exceed the amount you paid to Wirri in connection with the event giving rise to such liability.
15. Miscellaneous:

• Australian Use Only: The Services are for Australian users only. 

• Waiver; Remedies: Our failure to exercise rights does not waive future rights. 

• Governing Law: These Terms are governed by Australian laws. 

• Disputes: Disputes will be resolved by binding arbitration in Australia.
